1. Scope and acceptance
These Terms govern the use of the website at warsawglitch.com and its subpages (the “Website”) and participation in events held under the WARSAW GLITCH brand (the “Festival”), organised by Warsaw Glitch LLC (the “Organiser”), with Fundacja Akcelerator Plus as co-organiser of selected programme elements. These Terms are regulations within the meaning of Art. 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
Using the Website, creating or using an account, signing in (including via Google), subscribing to the newsletter, buying a ticket, registering, obtaining accreditation, accessing protected materials, entering the event area on the basis of any entitlement, or taking part in any Festival activity means that you have read and accept these Terms and the Privacy Policy, and, to the extent applicable, the ticket and submission rules set out below. Failure to comply with these Terms may result in refusal of entry, removal from the venue and revocation of a pass or accreditation without a refund, on the terms below.
2. Definitions, organiser and protected parties
“Organiser” means Warsaw Glitch LLC. “Protected Parties” means, jointly: the Organiser, the co-organiser (Fundacja Akcelerator Plus), their members, founders, the festival founder, team members, employees and collaborators (including programmers, producers, curators, selectors, jurors, volunteers and technical and production staff), subcontractors, the marketing and communications team, agencies, operators, photographers, partners, media partners, sponsors and suppliers, in each case acting for or on behalf of the Organiser or taking part in delivering or communicating the Festival, and their successors and licensees. All releases, liability limitations, permissions, licences and indemnities in these Terms are also established for the benefit of the Protected Parties.
The names, logotypes and brands WARSAW GLITCH, GL1TCH, Intellectual Property Awards / Glitch Awards, International Producers Forum, Glitch Academy, AnimatICON and Pixel Zone, together with related identification, are proprietary names, trademarks and reserved brands of the Organiser (or used by it under licence) and are protected by law. All rights not expressly granted are reserved to the Organiser.
3. Festival information and programme changes
WARSAW GLITCH takes place on 28-30 August 2026 at the Palace of Culture & Science / Kinoteka in Warsaw, Poland. The programme, guests, speakers, jurors, hours, rooms, formats and venue arrangements are provisional and may change, including for reasons beyond the Organiser’s control. The Organiser reserves the right to change them. Changing or cancelling an individual programme item, guest, time or location does not amount to cancelling the Festival, is not a defective performance as long as the general character of the event is preserved, and does not in itself give rise to any claim or to a right to a refund.
This document, the Terms, the Privacy Policy, the Cookie Policy and the ticket and submission rules may be amended by the Organiser for valid reasons (in particular changes in law, scope of services, technology, providers or the way the event is organised). The current version is published on the Website with its effective date. To contracts already concluded, the version in force at the time of conclusion applies, unless mandatory law provides otherwise.
Announcements, demonstrations, previews, prototypes, product or technology mentions and any forward-looking statements made by the Organiser, partners, sponsors or speakers are for information only and do not constitute a commitment, guarantee or obligation to deliver any feature, product, result or outcome. Such content may change or be withdrawn and is not a basis for any claim.
4. Tickets, passes and purchase
Admission to the Festival is by a valid pass or ticket (“Ticket”). Ticket types, scope of entitlements, validity, capacity and prices are published on the Website at the time of purchase; prices are gross and include applicable taxes unless stated otherwise. Payments are handled by the payment operator Stripe; the Organiser does not store full payment-card data. Concluding and paying for an order constitutes a contract of sale between the buyer and the Organiser. A condition of purchase is acceptance of these Terms and the Privacy Policy and, as regards image, acceptance of § 11 by ticking the relevant box.
Tickets are personal (issued to a named holder). Resale or transfer of a Ticket to another person is permitted only with the Organiser’s prior consent. The Organiser may introduce ticket pools, time-limited offers, discounts and free admission for designated groups (e.g. free entry for students of partner universities), on the conditions described for each Ticket; free Tickets are not exchangeable for cash.
For paid registrations or accreditations invoiced to a buyer (e.g. industry or company purchases), placing an order creates a binding obligation to pay; non-payment does not amount to cancellation, and the Organiser may pursue the amount due. The buyer remains liable for the fee regardless of attendance, whether the order was placed by the participant or by another buyer on their behalf.
5. Final sale, withdrawal and refunds
Under Art. 38(1)(12) of the Polish Act of 30 May 2014 on Consumer Rights, the right to withdraw from a distance contract does not apply to contracts for services connected with leisure, entertainment, cultural or similar events if the contract specifies the day or period of performance. Tickets to WARSAW GLITCH concern specified festival days; therefore a consumer does not have a 14-day statutory right of withdrawal, and the purchase of a Ticket is final and non-refundable. The buyer is informed of, and confirms, the absence of the right of withdrawal before placing the order.
Tickets are not refundable or exchangeable, except: (a) where the Organiser cancels the Festival for reasons attributable to it, the buyer is entitled to a refund of the price paid or, where offered, transfer to another date or an equivalent service; (b) where the Organiser changes the date in a way that materially prevents participation, the buyer is entitled to a refund of the Ticket price; and (c) to the extent mandatory consumer law provides otherwise. Refunds are made by the original payment method. The Organiser does not reimburse additional costs incurred independently of the Ticket price (e.g. travel or accommodation), to the extent permitted by law. Changes to the programme, guests, hours or locations are not grounds for a refund as long as the general character of the event is preserved.
6. Admission, identity checks and refusal of entry
A valid Ticket or accreditation is required for entry and may be checked at any time. Because Tickets are personal, at entry the holder may be asked to confirm their identity (an identity check), and entry may be refused where the person is not the same person to whom the Ticket was issued or who purchased it. The Organiser and its staff may also refuse entry to, or remove from the venue, any person who is under the influence of alcohol or narcotics, behaves aggressively, poses a safety risk, breaches these Terms or venue rules, or refuses an identity or security check, in each case without a refund of the Ticket price, to the extent permitted by law.
The Organiser reserves the right to refuse entry to, or remove from the venue, any person, including without stating a reason, where necessary to protect the safety of attendees, staff, performers and the event, in a manner consistent with mandatory law. The Festival cooperates with a security company whose staff may carry out checks and escort a person off the premises. The Organiser is entitled to call the Police and to notify the relevant law-enforcement authorities.
7. Capacity, priority access and registration
Entry to screenings, panels, workshops and other formats is subject to capacity and to venue and safety rules, and may be on a first-come basis even with a valid Ticket. Priority of entry is given to holders of valid Tickets and accreditations (including industry passes) according to the rules announced for a given format. Panels, workshops, pitching, industry sessions and similar formats may require advance registration (sign-up), may have a limited number of places, prerequisites, or require a specific pass or invitation; a reserved place may be released if the participant does not arrive on time.
8. Filming, photography and accredited media
Filming and recording on the event premises is prohibited. In particular, recording or photographing films, performances, presentations and other protected programme content is not permitted. Only accredited media may carry out filming, photography, interviews and similar activities on the event premises during the Festival, within the scope of their accreditation and the Organiser’s instructions. The Organiser and the Protected Parties may record the event for documentation and promotion under § 11. Personal photography may be allowed only in designated public festival areas where indicated, and may be further limited by venue and event rules.
9. Code of conduct
WARSAW GLITCH is an inclusive event, free from harassment and violence. Every person on the premises is required to comply with these Terms, venue rules, safety rules and the instructions of the Organiser, its staff and security. The following are strictly prohibited and not tolerated in any form, whether in person, online or in connection with the Festival:
- harassment, including sexual harassment, stalking, unwanted physical contact and persistent unwanted attention;
- discrimination, intimidation, hostile, degrading or humiliating behaviour based on sex, gender, identity, sexual orientation, disability, appearance, ethnicity, national origin, religion, age or any other characteristic;
- abusive, threatening, aggressive or violent behaviour, threats, incitement to violence and the bringing of weapons or dangerous objects;
- disrupting talks, screenings, panels, workshops, the gala or other events, and obstructing performers, speakers, staff or other attendees;
- hate speech, defamation, sustained disruption, doxxing, recording or photographing others without their consent, and unauthorised recording of protected content;
- being under the influence of alcohol or narcotics in a way that affects safety or order, and any conduct that endangers the safety of others or breaches the law.
Reports of prohibited conduct can be made to festival staff or at contact@warsawglitch.com and will be handled with discretion. The Organiser may take any measures it considers appropriate, including those in § 10.
10. Enforcement, security and authorities
To protect attendees, staff, performers and the event, the Organiser, its staff, venue staff and the cooperating security company may, in particular: issue a warning; refuse entry; remove a person from the venue; revoke a Ticket, pass or accreditation without a refund; refuse entry without stating a reason where necessary for safety; and call the Police and notify the relevant law-enforcement authorities. The Organiser may pursue claims for damage caused by a person to the Organiser, the Protected Parties, the venue or third parties. Measures are applied in a manner consistent with mandatory law.
11. Image, voice and statements of participants
The Organiser is entitled to record the course of WARSAW GLITCH in the form of photographs and video and audio recordings, which may capture the image, voice and statements of participants in connection with the event (including screenings, panels, workshops, the gala, industry meetings, networking zones, partner activations and other festival activities). A participant who buys a Ticket, registers, receives accreditation or enters the event area on the basis of a valid entitlement confirms that they have read these Terms and have been informed that the event may be recorded.
Acceptance of these Terms or the participation terms, confirmed by actively ticking the relevant box during purchase or registration, constitutes the Organiser’s free-of-charge permission, within the meaning of Art. 81(1) of the Act on Copyright and Related Rights, to disseminate the image, voice and statements of the participant recorded during the event. The permission covers the use and dissemination of materials connected with WARSAW GLITCH for a period of 10 years from the end of the given edition, without territorial limits, in particular in the Website, the Organiser’s social channels, press materials, printed or digital programmes and catalogues, reports, promotional films, presentations and materials informing about, documenting and promoting current and future editions of the Festival. The permission covers the fields of exploitation of recording and reproduction by any technique, marketing, public availability so that anyone may access the material at a place and time of their choosing, broadcasting, rebroadcasting, display and playback. The permission is free of charge and does not transfer rights to the participant’s image.
The permission does not cover use of the participant’s image by third parties for their independent advertising unconnected with WARSAW GLITCH. The Organiser may, however, use subcontractors, media partners, producers, agencies, operators and other Protected Parties acting for it or taking part in the Festival’s communication, solely for the purposes above, with the right to sublicense to them. Where a person is merely a detail of a whole (e.g. a gathering or public event), their image may be disseminated under Art. 81(2)(2) of the Act, without separate permission. A person who is the main, individually recognisable subject of a separately produced promotional material (e.g. a speaker, juror, performer, ambassador or special guest) may be covered by a separate agreement or consent; this section neither limits nor replaces such a separate arrangement where required. A participant may submit a reasoned individual request regarding future use of their clearly recognisable image or voice; such a request does not affect the lawfulness of earlier recording or dissemination and does not require the withdrawal of materials already printed, submitted for publication, lawfully published or archived, unless mandatory law provides otherwise.
12. Film and project submissions
Film, animation and project submissions (“Works”) are made on the terms of the given call, via FilmFreeway or another stated channel. By submitting and accepting these Terms, the submitter represents and warrants that: they hold full rights or appropriate authorisations to submit the Work and to provide the materials; the Work and materials do not infringe the rights of third parties, including copyright, related rights, image rights, personal rights, trademarks or trade secrets; they have obtained all required consents, licences and permissions (including for music, archival materials, performers and creators); and they have fulfilled the information obligations required by data-protection law towards persons named in the submission. The submitter is responsible for the truthfulness, accuracy and completeness of the data and materials. Submitted materials may be screened, including by third-party and AI-based software, for compliance with copyright, originality and the submission rules.
By submitting, the submitter grants the Organiser a non-exclusive, royalty-free, worldwide licence, with the right to sublicense to the Protected Parties, to use the Work and submission materials to the extent needed to assess, select, organise, present and promote the Festival, including: storage and reproduction for assessment and selection; presentation of the Work during the Festival (competition and non-competition screenings); the right to display the Work and to make it available on the Organiser’s GLITCH platform and on cooperating streaming platforms associated with the Festival; and the use of excerpts (of a customary length, e.g. a trailer or an excerpt of up to 3 minutes), the poster, stills, description, trailer and press materials in the Website, catalogue, programme, announcements, social channels, reports and festival archives. Submission does not transfer the author’s economic rights to the Work, which remain with the rights holders, subject to the licence granted. Full public presentation of the entire Work takes place only to the extent agreed upon selection.
Decisions on admission, selection, qualification and awards are made by the Organiser, selectors or jury and are final; a submission does not guarantee qualification or presentation. The Organiser is not obliged to label a Work, in its communications, the Website, the GLITCH platform, screenings or media materials, as created with or without the use of artificial intelligence, and the manner of any such description rests with the Organiser. The submitter undertakes to indemnify and hold harmless the Organiser and the Protected Parties against any third-party claims, liability, costs and expenses (including reasonable legal costs) arising from a breach of the above representations or from use of the Work in accordance with the licence granted. Publication of crew and team data is carried out as described in the Privacy Policy.
13. Intellectual property and website use
The WARSAW GLITCH brand, the names and marks listed in § 2, the layout and content of the Website, texts, graphics, photographs, recordings, programme materials and festival materials are the exclusive property of the Organiser or are used by it under licence and are protected by law. Copying, reproducing, distributing, modifying, publicly making available or commercially exploiting any elements of the Website or Festival without the Organiser’s prior written consent is prohibited, save within the limits of permitted use under mandatory law. The user must use the Website lawfully, must not provide unlawful content, must not circumvent security measures, must not access restricted areas without authorisation, and must not scrape data without consent. Films and works shown at the Festival remain the property of their rights holders.
14. Limitation of liability, lost items and force majeure
To the fullest extent permitted by mandatory law, the liability of the Organiser and the Protected Parties in connection with the use of the Website and participation in the Festival is limited. The Organiser is not liable for indirect or consequential loss, lost profits or data, and the total liability of the Organiser towards a participant who is not a consumer, under a given contract, is limited to the amount actually paid by that participant for the service to which the claim relates. The Organiser is not responsible for non-performance or improper performance caused by force majeure or circumstances beyond its reasonable control (including decisions of authorities, states of emergency, epidemics, outages, the acts of third parties and of service providers, including Stripe, Google, FilmFreeway and infrastructure providers). The Organiser is not responsible for items lost, left or damaged at the venue, or for the belongings of participants; participants are responsible for their own belongings and act at their own risk while observing safety rules.
Nothing in these Terms limits liability that cannot be limited by mandatory law, in particular for damage caused intentionally, for harm to life or health, or the rights of a consumer. A user, participant or submitter who is not a consumer undertakes to indemnify and hold harmless the Organiser and the Protected Parties against third-party claims, liability, costs and expenses (including reasonable legal costs) arising from that person’s breach of these Terms, the law or third-party rights, or from the untruthfulness of their statements.
15. Assumption of risk, release and eligibility
Participation in the Festival, including attendance, travel to and from the venue, demonstrations, workshops, networking and the use of equipment, is at the participant's own risk. To the fullest extent permitted by mandatory law, the participant assumes all risks, known and unknown, connected with participation, and releases the Organiser and the Protected Parties from any claims, demands and causes of action arising from or connected with participation. This release does not apply to liability that cannot be excluded under mandatory law, in particular for damage caused intentionally, for harm to life or health, or the rights of a consumer.
By taking part, the participant warrants that they may lawfully participate, that they are not subject to applicable sanctions or trade restrictions that would prohibit their participation, and that they will comply with applicable law and the rules of the venue. The Organiser may refuse or end participation where this is not the case.
Where the Organiser uses third-party or AI-based services (e.g. for networking, recaps, summaries or personalisation), those providers act under contract and may not use participant data to train their own models or for their own marketing. Badge or lead-retrieval scanning that shares your data with a sponsor or partner takes place only where you opt in or interact directly with that sponsor or partner.
16. Complaints, governing law and disputes
Complaints may be submitted to contact@warsawglitch.com, with the details needed to identify the matter; the Organiser responds within 14 days for consumers and 30 days otherwise. A consumer may use out-of-court complaint and redress procedures, including the EU ODR platform at ec.europa.eu/consumers/odr; use of these methods is voluntary. These Terms are governed by Polish law and EU law, which does not deprive a consumer of the protection of the mandatory provisions of their country of habitual residence. Disputes with a participant who is not a consumer are settled by the court having jurisdiction over the Organiser’s seat; disputes with consumers are settled by the courts competent under applicable provisions. The application of consumer rules follows the standards of the Office of Competition and Consumer Protection (UOKiK).
If any provision of these Terms is found invalid or ineffective, the remaining provisions remain in force, and the invalid provision is replaced by one closest to its economic purpose and compliant with the law. In the event of a discrepancy between documents: privacy matters are governed by the Privacy Policy; cookie matters by the Cookie Policy; otherwise by these Terms.
